4. AI Processing and Model Improvement
Habimotion uses AI and automated systems to analyse Inputs and generate Outputs. This may involve sending Inputs, extracted listing data, prompts, images, videos, metadata, and generated materials to third-party AI, cloud, image, or video providers that process data on our behalf.
We may use project data, usage data, technical data, derived data, de-identified data, aggregated data, and feedback to improve the Service, safety systems, product quality, reliability, and user experience.
Whether customer content is used for model training or general product improvement may depend on your plan, settings, provider configuration, or written agreement. If a paid plan, enterprise agreement, or written order states that customer content will not be used for model training or general product improvement, that more specific term will control for the covered content.
We do not use AI Outputs as legal, property, valuation, inspection, architectural, renovation, engineering, or compliance advice. Users are responsible for reviewing Outputs before publication or reliance.
5. Legal Bases and Consent
For Singapore users and processing subject to Singapore law, we collect, use, and disclose personal data where you have provided consent, where consent is deemed or permitted under applicable law, where processing is necessary to provide the requested Service, or where another exception or basis under the Personal Data Protection Act 2012 applies.
For users in jurisdictions that require a specific legal basis, such as the European Economic Area or the United Kingdom, our legal bases may include:
- performance of a contract with you;
- your consent;
- compliance with legal obligations;
- our legitimate interests, including providing, securing, improving, and developing the Service; and

We do not sell personal data in the ordinary sense of exchanging it for money. Some privacy laws define “sale”, “sharing”, or “targeted advertising” broadly. If those laws apply to us and our activities, we will provide required notices and choices.
7. International Transfers
We operate from Singapore and may use service providers located in Singapore, the United States, Europe, Australia, New Zealand, Canada, and other countries. Your personal data may be transferred to, stored in, or processed in countries other than your own.
Where Singapore law applies, we will take steps required by the Personal Data Protection Act 2012 to ensure that personal data transferred overseas receives a standard of protection comparable to the protection under Singapore law, unless an exception applies.
Where other data transfer laws apply, such as GDPR transfer rules, we will use appropriate safeguards where required.

We retain personal data for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service, maintain accounts, support projects, comply with legal and accounting obligations, resolve disputes, enforce agreements, prevent fraud, maintain security, and improve the Service.
Retention periods may vary depending on the type of data, account status, plan, project settings, legal obligations, backup practices, and operational needs. We may delete or anonymise inactive account data, uploaded materials, generated Outputs, logs, and project data after a reasonable period, subject to applicable law and any written agreement.
You may request deletion of certain data, but we may retain information where required or permitted for legal, security, fraud prevention, accounting, backup, dispute-resolution, or legitimate business purposes.

We use reasonable administrative, technical, and organisational measures designed to protect personal data against unauthorised access, collection, use, disclosure, copying, modification, disposal, loss, or similar risks. These measures may include access controls, encryption, logging, provider due diligence, monitoring, security reviews, and staff or contractor controls.
No method of transmission or storage is completely secure. You are responsible for keeping your account credentials secure and for limiting access to your account, projects, and generated materials.
If a data breach occurs, we will assess the incident and notify affected individuals, customers, regulators, or other parties where required by applicable law.

We may send marketing communications where permitted by law. You can opt out of marketing emails by using the unsubscribe link or contacting us. Even if you opt out of marketing, we may still send non-marketing service messages.
If we send marketing messages in jurisdictions with specific direct marketing, electronic messaging, anti-spam, or do-not-call rules, we will follow those rules where they apply.

Most browsers allow you to block or delete cookies. If you disable cookies, some parts of the Service may not work properly.
13. Children
Habimotion is a business and professional real estate marketing service. It is not intended for children, and we do not knowingly collect personal data directly from children.
You must not upload children’s personal data, images of children, school information, or child-related sensitive information unless you have all required authority and we have expressly agreed in writing where required.
If you believe we have collected children’s personal data improperly, contact us so we can review and take appropriate action.
14. Business Customers and Data Intermediary Roles
Where a business customer provides personal data to Habimotion for processing on its behalf, the customer may be the organisation or controller responsible for that personal data, and Habimotion may act as a data intermediary, processor, or service provider depending on the applicable law and written agreement.
Business customers are responsible for ensuring they have the right to provide personal data and Inputs to us, including any necessary notices, consents, lawful bases, owner permissions, tenant permissions, employee permissions, agent permissions, photographer permissions, and listing-platform permissions.
If required for enterprise customers, agency customers, or customers subject to specific data protection laws, we may enter into a separate data processing agreement. Where required by law, we will take reasonable steps to ensure personal data likely to be used to make a decision affecting an individual or disclosed to another organisation is accurate and complete.

We may update this Privacy Policy from time to time. When we do, we will post the updated version and change the “Last Updated” date. If changes are material, we may provide additional notice where appropriate.
