Habimotion Terms of Service

These Terms of Service govern access to and use of Habimotion, an AI video platform that helps users generate real estate walkthrough videos, before and after videos, property marketing videos, and related media from listing URLs, uploaded images, prompts, instructions, and other materials. Habimotion is operated by KAE Venture Studio Pte. Ltd., a company registered in Singapore, unless a different contracting entity is stated in an order form, invoice, or written agreement.
By creating an account, clicking to accept these Terms, paying for the Service, submitting materials, or otherwise accessing or using the Service, you agree to these Terms. If you use the Service for a company, agency, brokerage, property developer, landlord, or other organisation, you represent that you have authority to bind that organisation, and references to “you” include that organisation.

1. The Service
Habimotion allows users to submit listing URLs, property images, floorplans, written prompts, property descriptions, branding materials, instructions, and other supported inputs in order to generate AI-assisted videos and related outputs. These may include walkthrough videos, before and after videos, renovation-style previews, staging previews, captions, scripts, thumbnails, metadata, and other real estate marketing assets.
We may make the Service available through websites, applications, APIs, integrations, hosted workflows, manual service workflows, or approved third-party platforms. We may add, remove, suspend, or change features at any time, including upload limits, generation limits, file size limits, supported listing sources, output formats, pricing, storage periods, and third-party providers.
The Service is intended to support marketing and creative production. It does not replace your own review, legal obligations, real estate advertising obligations, agency obligations, professional judgment, or platform compliance obligations.
2. Eligibility
You must be at least 18 years old to use the Service unless we expressly allow a lower age for a specific feature and applicable law permits it. You must not use the Service if applicable law, sanctions, export controls, platform rules, or contractual obligations prohibit you from doing so.
If you use the Service on behalf of a business or organisation, you are responsible for ensuring that all users under that account comply with these Terms.
3. Accounts and Security
You may need to create an account or provide contact, billing, or project information to use parts of the Service. You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for keeping login credentials, API keys, and account access secure. You are responsible for all activity under your account, including activity by employees, contractors, collaborators, and other authorised users. You must notify us promptly if you believe your account has been accessed without authorisation.
We may suspend, restrict, or terminate access if we believe account activity is unlawful, abusive, insecure, fraudulent, unpaid, or inconsistent with these Terms.
4. User Inputs
“Inputs” means anything you upload, submit, link, import, describe, prompt, provide, or otherwise make available through the Service. Inputs may include listing URLs, photographs, videos, floorplans, text, property descriptions, addresses, agent details, owner details, branding, logos, music, captions, metadata, prompts, edits, comments, and instructions.
You retain ownership of your Inputs, subject to any rights held by third parties. You are solely responsible for your Inputs and for ensuring that you have all rights, licences, consents, permissions, and authority needed to submit them to the Service and use the resulting outputs.
By submitting Inputs, you represent and warrant that:
- you have the right to use and submit the Inputs;
- your submission and our processing of the Inputs will not infringe or violate any copyright, trademark, publicity, privacy, confidentiality, contractual, database, platform, listing-site, real estate, or other rights;
- you have obtained any necessary consent from property owners, tenants, occupants, landlords, agents, agencies, developers, photographers, videographers, listing platforms, and other relevant parties;
- the Inputs do not include unlawful, misleading, harmful, confidential, or sensitive material unless you are authorised to provide that material and we have agreed to process it; and
- the Inputs and your use of outputs will comply with all laws, regulations, professional rules, agency rules, advertising rules, and platform requirements that apply to you.
5. Listing URLs and Third-Party Listing Materials
If you submit a real estate listing URL, you are instructing us to access, analyse, extract, process, or use information from that URL to provide the Service. Listing information may include property images, descriptions, asking price, address or location, floor area, room count, agent information, agency branding, amenities, listing metadata, and other publicly available or user-provided listing details.
You are responsible for ensuring that your use of any listing URL and listing material is permitted by the relevant listing platform, property owner, agency, photographer, and applicable law. We do not guarantee that a listing website permits scraping, automated access, reuse, or transformation of its content. We may refuse to process, limit processing of, or remove materials from certain websites or sources.
References to third-party listing platforms, agencies, developers, portals, or services do not imply affiliation, sponsorship, endorsement, or approval.
6. Licence You Grant to Us
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, analyse, transform, transmit, display, modify, create derivative works from, and otherwise use your Inputs and related data as reasonably necessary to:
- provide, operate, maintain, secure, and support the Service;
- generate, edit, host, store, and deliver outputs requested by you;
- provide customer support, moderation, safety review, troubleshooting, fraud prevention, billing, and analytics;
- comply with law and enforce these Terms; and
- improve and develop the Service, subject to any product settings, plan terms, enterprise agreement, or written agreement that limits such use.
We may use service providers and subprocessors to provide the Service. Those providers may process Inputs and outputs for hosting, storage, AI generation, image analysis, video generation, payment processing, analytics, support, security, and related operational purposes.
Where a paid plan, enterprise agreement, or written order states that customer content will not be used for model training or general product improvement, that more specific term will control for the covered content.
7. Generated Outputs and Commercial Use
“Outputs” means videos, images, scripts, captions, thumbnails, metadata, previews, edits, variations, and other results generated, edited, or produced through the Service.
As between you and Habimotion, and subject to your compliance with these Terms, we assign to you any rights we may have in Outputs generated for your account. You may use Outputs for commercial real estate marketing purposes if your plan, order, or written agreement permits commercial use.
This assignment does not give you ownership of our software, models, prompts, workflows, templates, user interfaces, infrastructure, know-how, technology, brand, or other intellectual property. It also does not give you rights in third-party materials, listing content, property photographs, music, logos, people, likenesses, trademarks, or other protected elements included in or reflected by the Outputs.
You are responsible for reviewing Outputs before publishing, distributing, sending, advertising, relying on, or monetising them. You are responsible for determining whether an Output is accurate, lawful, properly disclosed, and suitable for your intended use.
8. AI-Generated Property Media
The Service uses AI and automated systems. Outputs may be inaccurate, incomplete, non-unique, unrealistic, biased, distorted, low quality, unavailable, or unsuitable for a particular purpose. Similar or identical outputs may be generated for other users.
AI-generated or AI-edited property media may alter or imply changes to a property, including furniture, fittings, lighting, views, wall colours, renovation condition, dimensions, cleanliness, defects, landscaping, staging, decor, ambience, appliances, and other property features.
You must not publish or use any Output in a way that is false, deceptive, misleading, or likely to mislead a buyer, tenant, landlord, owner, regulator, platform, or other viewer. You must clearly disclose AI generation, AI enhancement, virtual staging, renovation simulation, before and after simulation, or material alteration where required by law, regulation, professional rules, listing-platform rules, or ordinary standards of fair dealing.
You must not represent that an AI-generated renovation, staging, furnishing, view, condition, layout, feature, or improvement is real unless it is accurate and verifiable. You must not use the Service to hide defects, misrepresent property condition, fabricate amenities, create false scarcity or pricing claims, impersonate an agent or owner, or otherwise create misleading property advertising.
9. Acceptable Use
You must not use the Service or Outputs to:
- violate any applicable law, regulation, court order, professional rule, listing-platform rule, or contractual obligation;
- infringe, misappropriate, or violate intellectual property, privacy, publicity, confidentiality, database, platform, or contractual rights;
- upload or process content that you do not have the right to use;
- create false, deceptive, or misleading real estate advertising;
- generate or distribute unlawful, defamatory, discriminatory, harassing, hateful, sexually exploitative, obscene, violent, harmful, fraudulent, or abusive content;
- upload malware, malicious code, or content that creates security or privacy risks;
- submit government identifiers, financial account numbers, health information, biometric identifiers, children’s information, or sensitive personal data unless we have expressly agreed in writing and applicable law permits it;
- use the Service to identify, profile, surveil, or track individuals without a lawful basis;
- reverse engineer, benchmark, copy, scrape, attack, overload, bypass, or interfere with the Service or its security controls;
- use the Service, Inputs, or Outputs to train, fine-tune, benchmark, or develop a competing AI video, real estate media, or listing automation product without our written permission; or
- resell, sublicense, or provide the Service to third parties except as allowed by your plan or written agreement.
We may review, block, remove, refuse, or restrict Inputs, Outputs, accounts, or activity that we believe may violate these Terms or create legal, security, operational, reputational, or user harm.
10. Payments, Credits, and Refunds
Paid features may be offered through subscriptions, packages, credits, pay-per-generation fees, agency plans, enterprise plans, or other pricing models shown at checkout or in an order form.
Fees are due when stated. If you fail to pay fees when due, we may suspend or limit access to paid features. Taxes, foreign exchange fees, card fees, payment processor fees, bank fees, and withholding obligations may apply depending on your location and payment method.
Unless required by applicable law or expressly stated by us in writing, payments are non-refundable. Credits or generation units may be consumed when a generation or covered action is initiated. Because AI outputs are inherently variable, dissatisfaction with a result does not automatically entitle you to a refund, credit, or reinstatement of consumed usage.
If you believe there has been a billing error, you must contact us within seven days after the charge so we can review it. We may suspend or terminate accounts that initiate bad-faith chargebacks or payment disputes after receiving the Service.
11. Free Trials, Beta Features, and Previews
We may offer free trials, beta access, previews, demo generations, promotional credits, or experimental features. We may change or withdraw them at any time. Beta and preview features may be unstable, inaccurate, incomplete, or discontinued, and may be subject to additional terms.
You are responsible for evaluating the Service before purchasing paid features.
12. APIs and Integrations
If we provide API access, automation features, webhook access, bulk generation, or third-party integrations, you must keep credentials secure, follow our documentation, comply with rate limits and technical restrictions, and use those features only for authorised purposes.
We may suspend or revoke API or integration access if we believe use is abusive, insecure, unlawful, excessive, or inconsistent with these Terms.
13. Our Intellectual Property
The Service, including software, models, prompts, workflows, templates, systems, algorithms, interfaces, documentation, designs, branding, and underlying technology, is owned by us or our licensors and is protected by intellectual property and other laws.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Service for its intended purpose.
You may not copy, modify, distribute, lease, sell, reverse engineer, decompile, disassemble, bypass, scrape, or create derivative works from the Service or its underlying technology except where these Terms or applicable law expressly permit it.
If you provide suggestions, ideas, comments, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use that feedback without restriction or compensation.
14. Privacy and Data Protection
Our handling of personal data is described in our Privacy Policy. Singapore’s Personal Data Protection Act 2012 and other applicable data protection laws may apply depending on the parties, locations, and processing activities involved.
By using the Service, you acknowledge that personal data may be collected, used, disclosed, transferred, stored, and processed as described in the Privacy Policy. If you submit personal data on behalf of another person or organisation, you are responsible for ensuring you have a lawful basis and any required consent or authority to do so.
15. Third-Party Services
The Service may rely on or link to third-party services, including hosting providers, AI model providers, image and video generation providers, payment processors, analytics providers, email providers, support tools, authentication providers, listing platforms, cloud storage providers, and other software or infrastructure providers.
We do not control third-party services and are not responsible for their availability, content, actions, omissions, terms, privacy practices, fees, or failures. Your use of third-party services may be subject to separate terms and policies.
16. Intellectual Property Complaints
We respect intellectual property rights and may remove or restrict access to materials that are alleged to infringe third-party rights.
If you believe content available through the Service infringes your rights, provide a notice that includes:
- your name and contact details;
- identification of the work or rights allegedly infringed;
- identification of the allegedly infringing material and information reasonably sufficient for us to locate it;
- a statement that you have a good faith belief that the disputed use is not authorised by the rights owner, its agent, or the law;
- a statement that the information in your notice is accurate and that you are authorised to act on behalf of the rights owner; and
- your physical or electronic signature.
We may request further information before taking action. We may suspend or terminate repeat infringers or users who submit materials that repeatedly violate third-party rights.
If you are subject to the United States Digital Millennium Copyright Act or similar regimes, you may include any information required under those regimes in your notice.
17. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.
We do not guarantee that the Service or any Output will be accurate, compliant, unique, complete, secure, error-free, uninterrupted, commercially successful, accepted by any listing platform, or suitable for any property transaction, advertisement, campaign, or professional requirement.
You are responsible for independently reviewing Outputs, property claims, disclosures, advertising copy, compliance obligations, and publication decisions before use.
18. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, revenue, data, goodwill, business opportunity, property transaction opportunity, listing performance, advertising performance, or customer relationships, arising out of or relating to the Service.
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the six months before the event giving rise to the claim or SGD 150.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
19. Indemnity
You will indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, contractors, agents, and representatives from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to:
- your use of the Service;
- your Inputs;
- your Outputs and how you use, publish, distribute, sell, license, or rely on them;
- your real estate advertising, property marketing, listing, agency, owner, tenant, buyer, landlord, developer, or platform obligations;
- your violation of these Terms or applicable law;
- your violation or alleged violation of third-party rights; or
- any dispute between you and your clients, agents, agencies, property owners, tenants, buyers, landlords, platforms, or other third parties.
We may assume control of the defence of any matter subject to indemnification, and you agree to cooperate with that defence.
20. Termination
You may stop using the Service at any time. We may suspend, restrict, or terminate your account or access if we believe you have violated these Terms, failed to pay amounts due, created risk for us or others, or if continued access would be unlawful, insecure, or commercially impractical.
Sections that by their nature should survive termination will survive, including provisions on Inputs, Outputs, licences, intellectual property, payments, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.
21. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version and change the “Last Updated” date. If changes are material, we may provide additional notice where appropriate.
Continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using the Service.
22. Governing Law and Disputes
These Terms and any dispute arising out of or relating to the Service are governed by the laws of Singapore, without regard to conflict of law rules.
The parties will first try in good faith to resolve any dispute informally within 30 days after written notice of the dispute. If the dispute is not resolved within that period, the courts of Singapore will have exclusive jurisdiction, except that either party may seek urgent injunctive or equitable relief in any court of competent jurisdiction where necessary to protect intellectual property, confidential information, security, or users.
If a separate written agreement or order form specifies arbitration or another dispute process, that written agreement will control for the covered relationship.
23. Market-Specific Terms
We operate from Singapore and may make the Service available globally. You are responsible for complying with laws, regulations, professional obligations, real estate advertising rules, consumer protection rules, data protection rules, AI disclosure rules, and platform terms that apply in the markets where you access the Service or publish Outputs, including Singapore, Australia, New Zealand, other Asia-Pacific markets, the European Union, the United Kingdom, the United States, Canada, and any other relevant jurisdiction.
Where mandatory local law gives you rights that cannot be waived, these Terms do not limit those rights. Where market-specific terms are published for a jurisdiction or agreed in writing, those terms will apply to the relevant users, transactions, or processing activities.
